Terms of Service

Welcome to Something Halal Inc., the premier Halal Foods ordering app. These Terms of Service govern your use of the Something Halal application and website (collectively referred to as the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service. Please read them carefully before using the Service.


1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.


2. Use of Service

2.1 Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.

2.2 License

Something Halal grants you a limited, non-exclusive, non-transferable license to use the Service solely for your personal and non-commercial use.

2.3 Restrictions

You agree not to:

  • Use the Service for any unlawful purposes or to violate these Terms of Service.
  • Interfere with the Service’s operation or attempt unauthorized access.
  • Engage in data scraping, reverse engineering, or other activities that violate data protection laws such as the Personal Information Protection and Electronic Documents Act (PIPEDA) or Quebec’s Act Respecting the Protection of Personal Information in the Private Sector.

3. Ordering and Payments

3.1 Ordering

  • By placing an order, you agree to pay the specified price for the products, including applicable taxes and fees.
  • All sales are final unless otherwise required by applicable laws, such as cancellation rights under the Consumer Protection Act (CPA) of Quebec or refund policies mandated in other Canadian provinces.

3.2 Commission

Something Halal charges restaurant partners a commission fee per order. These fees are disclosed to restaurant partners during onboarding.

3.3 Payments

  • All payments are processed securely through a third-party payment processor compliant with Canadian data and financial laws.
  • Something Halal reserves the right to amend pricing or payment terms with reasonable notice to users.


4. Certification and Dispute Resolution

4.1 Certification

  • Restaurants are solely responsible for the accuracy of their Halal certification claims. Something Halal does not independently verify these claims at this time but encourages restaurants to upload valid certification documents.

4.2 Verification

  • Users should verify Halal certification with the restaurants directly. Something Halal does not guarantee the reliability of the certification information provided.

4.3 Dispute Resolution

  • Customers agree to resolve disputes with restaurants directly.
  • If disputes remain unresolved, Something Halal may mediate as a final step.
  • Disputes in Quebec are subject to the CPA’s dispute resolution framework.


5. Compliance for Restaurant Partners

5.1 Business and Information Accuracy

Restaurant partners must:

  • Provide accurate and current information about their business, including licenses, Halal certification, and operational details.
  • Ensure all menu descriptions are truthful and complete, including clear identification of ingredients and their sources. For example:
  • Any substitute ingredients, such as chicken salami or turkey strips, must be explicitly labeled to prevent misrepresentation.
  • Mislabeling items, such as using the term "halal-pepperoni" for a Halal substitute without clarification, is strictly prohibited.

Misrepresentation of business details, Halal certification, or menu items may result in removal from the platform.

5.2 Legal and Operational Obligations

Restaurant partners must comply with all applicable laws and regulations, including:

  • Food Safety and Health Standards: Adherence to standards outlined by the Canadian Food Inspection Agency (CFIA) and regional health authorities regarding food preparation, handling, and service.
  • Halal Certification Compliance: Partners must ensure that all items labeled as Halal meet the required standards, supported by valid and current certification.
  • Quebec Privacy Laws: Quebec-based partners must comply with Bill 25 regarding the processing and protection of personal information.
  • Ingredient Transparency: Partners must disclose potential allergens, ingredient substitutions, and compliance with Halal standards for all menu items.

5.3 Non-Compliance and Penalties

Failure to comply with the above requirements may result in:

  • The immediate removal of inaccurate menu items.
  • Suspension or permanent removal from the platform for repeated violations or serious breaches, such as mislabeling ingredients or Halal compliance.
  • Notification to regional authorities if non-compliance poses health or safety risks.


6. Compliance for Drivers

6.1 Authorization, Licensing, and Vehicle Standards

  • All drivers must possess a valid driver’s license appropriate for their region and meet all regional and provincial vehicle insurance requirements.
  • Drivers must ensure that their vehicles meet the following maintenance and safety standards:
  • Routine maintenance, including regular oil changes, tire inspections, and brake checks.
  • Compliance with local safety regulations, including functioning headlights, taillights, and seat belts.
  • Adequate cleanliness and sanitation, particularly in areas where food is transported, to prevent contamination.
  • Drivers are required to address any vehicle issues promptly to avoid unsafe or inadequate delivery conditions.

6.2 Privacy, Tracking, and Safe Operations

  • Driver tracking is mandatory to ensure operational efficiency and transparency. Tracking data is collected and managed in compliance with PIPEDA and Quebec’s privacy laws.
  • Drivers must operate vehicles responsibly, adhere to traffic laws, and follow all safety protocols while on delivery routes.

6.3 Conduct and Substance-Free Operation

  • Drivers are strictly prohibited from operating their vehicles while under the influence of alcohol, drugs, or any other substances that impair their ability to drive safely.
  • Any driver found to be under the influence while delivering orders will face immediate removal from the platform and may be reported to local authorities.
  • Drivers are expected to conduct themselves professionally and adhere to local and regional bylaws. This includes refraining from walking on private property, such as lawns, and avoid blocking or parking in driveways unless the delivery is intended for that location.

6.4 Third-Party Partnerships

  • Drivers employed via third-party delivery services must adhere to the terms and conditions set forth by those services. Third-party services are also expected to ensure compliance with the standards outlined in this section.


7. Compliance for Customers in Quebec

7.1 Applicability

Quebec residents are entitled to protections under the Consumer Protection Act (CPA) and related provincial regulations.

7.2 Consumer Rights

Customers in Quebec have cancellation rights, warranty protections, and rights to refunds where applicable.

7.3 Language Compliance

All terms and information will be available in both English and French in compliance with Bill 96. Communication may be provided in French if adequate staff are hired to meet multi-lingual requirements.

7.4 Jurisdiction

All legal disputes arising in Quebec will be governed by Quebec laws and resolved in its courts.


8. Multi-Device Usage

8.1 Account Security

Users are responsible for securing their account credentials. Enabling features like two-factor authentication is recommended.

8.2 Device Limits

To ensure fair usage, the Service may limit simultaneous logins per account.


9. Privacy and Data Protection

9.1 Data Collection

  • User data is collected and stored in compliance with Canadian privacy laws, including PIPEDA and Quebec’s privacy regulations.
  • Users have the right to request access to, correction of, or deletion of their personal data.
  • Certain data may be retained for a period not longer than 7 years for financial reporting or auditing purposes.

9.2 Cross-Border Transfers

Personal data processed outside Canada will be managed under agreements ensuring equivalent data protection standards.


10. Changes to Terms

Something Halal reserves the right to modify these Terms with reasonable notice. Significant changes will be communicated via email or app notifications.


11. Governing Law

These Terms of Service are governed by Canadian federal laws and the laws of the province where the user resides, including Quebec-specific laws where applicable.
